General conditions of use

Purpose of the Terms of Use:

The present General Conditions of Use (hereinafter “GCU”) define the contractual framework of the relationship between Hopscotch Congrès and the User of the Festival Diapason de Megève Classiquicime website (hereinafter the “Site”). Hopscotch Congrès reserves the right, at any time, to modify, supplement or delete, and more generally to update, all or part of these terms of use. Hopscotch Congrès will inform each visitor to the Site (the “User”) of any changes made to these conditions of use.

 

If the User does not comply with these terms of use and Hopscotch Congrès does not take immediate action, this does not mean that Hopscotch Congrès waives its rights to take further action.

 

Site content:

The purpose of the Site is to provide information about the activity and news related to the Diapason de Megève Classiquicime Festival and to register for events. The information on the Site is indicative and general, and by no means exhaustive.

Hopscotch Congrès reserves the right to correct the content of the Site at any time and without notice, or to suspend or interrupt access to it. Despite all the care and rigor taken in the creation of the Site and its regular updating, errors may have crept into the information presented. Users of the Site should therefore carry out all necessary checks and are solely responsible for the use they make of the information accessible, without Hopscotch Congrès being held liable. Hopscotch Congrès makes every effort to provide Users with available and verified information and/or tools, but cannot be held responsible for errors, lack of availability of information and/or the presence of viruses on its site.

User commitment:

The Site User acknowledges that he/she has the necessary skills and means to access and use the aforementioned website.

The Site User acknowledges having checked that the computer configuration used does not contain any virus and is in perfect working order.

 

The User must not use the Site or its content for any purpose that is unlawful or prohibited by these terms of use, or to encourage any illegal activity or any other activity that infringes the rights of Hopscotch Congrès or third parties.

The User is not authorized to use any device, program, algorithm or other automatic method to access, acquire, copy or monitor any portion of the Site, or to reproduce or circumvent the navigational structure or presentation of the Site in order to obtain data, documents or information. The User may only extract and/or reuse data, documents or information from the Site where expressly authorized to do so. The User shall not attempt to gain unauthorized access to any section or feature of the Site, or to any other system or network connected to the Site, or to the services offered on the Site, by hacking or any other illegitimate means.

 

The User shall not attempt to analyze or test the vulnerability of the Site or any network connected to the Site, nor breach the security and authentication measures implemented on the Site or networks connected to the Site. The User is not authorized to interrogate or trace information on other Users, or Hopscotch Congrès customers, in particular any User account of which it is not the holder or its source, nor to exploit the Site or the services or information made available via the Site, in any manner whatsoever, with the aim of revealing such information, in particular personal identification information or information other than its own information, as it appears on the Site. The User agrees not to take any action that would impose an unreasonable or disproportionately large load on the infrastructure of the Site or the systems or networks of Hopscotch Congrès, or any system or network connected to the Site or to Hopscotch Congrès. The User agrees not to use any device or software to interfere or attempt to interfere with the proper working of the Site or any transaction conducted on the Site or the use of the Site by any other person. The User shall not attempt to forge headers or otherwise manipulate identifiers in order to disguise the origin of any message or transmission sent to Hopscotch Congrès via the Site, or any service offered via the Site. The User must not pretend to be or represent someone else, nor impersonate any other person or entity.

Hopscotch Congrès reserves the right, at any time, to modify or discontinue, temporarily or permanently, the use of this Site and shall not be liable for any such changes, suspensions or discontinuances. Hopscotch Congrès also declines all responsibility for malfunctions or interruptions in the use of the Site due to a power failure, a failure of telephone lines and/or the Internet, or any other harmful event beyond its control.

Technical information:

Hopscotch Congrès cannot be held responsible for elements beyond their control or for any damage to the User's technical environment, in particular computers, software, network equipment and any other equipment used to use the Site and/or the information contained therein.

Transmissions via the Internet are never totally confidential or secure, and it is the responsibility of each User to take all appropriate measures to protect their own data and/or software from contamination by any viruses circulating on the Internet.

​The User agrees to indemnify and hold Hopscotch Congrès harmless from any loss or claim arising from actions initiated by third parties due to, or in connection with, the User's own use of the Site.

No warranty:

Hopscotch Congrès makes every effort to keep this Site up to date. Nevertheless, Hopscotch Congrès cannot guarantee the accuracy or completeness of any information provided.

 

Consequently, and to the extent permitted by applicable law, Hopscotch Congrès disclaims all liability for any indirect damage, whatever the cause, origin, nature or consequences, arising from or in connection with a visit to the Site, including, without limitation, any loss of profits, interruption of business, loss of software or data.

Hyperlinks:

The creation of hypertext links to the Site is subject to the prior and express agreement of Hopscotch Congrès.

The Site may contain hypertext links to other websites. The existence of a hypertext link between the Site and a third-party site in no way implies that Hopscotch Congrès approves of the content of this site or the use that may be made of it, and shall not, under any circumstances, incur its liability. Users visit other sites at their own risk and under their own responsibility. Hopscotch Congrès may not be held liable for access by users to hypertext links set up within the framework of the website leading to other resources on the Internet. Users are reminded that delays, omissions or inaccuracies may occur due to the electronic transmission system.

Copyright - Intellectual property:

All elements of the Site, taken individually or as a whole, are subject to applicable legislation on intellectual property, copyright and trademark law, both as regards form (tree structure, data layout, design, user-friendliness, etc.) and content (trademarks, texts, images, illustrations, music, sounds, etc.). These elements are the exclusive property of Hopscotch Congrès or are licensed to it and Hopscotch Congrès are the only authorized users. Any reproduction, representation or distribution, in whole or in part, of the pages, data and any other element of the Site, by any process or medium whatsoever, as well as their alteration, is prohibited, except with the prior written authorization of Hopscotch Congrès, and would constitute an infringement punishable by articles L.335-2 et seq. of the French Intellectual Property Code. The trademarks of Hopscotch Congrès and its partners, as well as the logos appearing on the site are semi-figurative or not and are registered. Any total or partial reproduction of these trademarks or logos from elements of the site without the express authorization of the website operator is therefore prohibited, within the meaning of article L.713-2 of the French Intellectual Property Code.

Applicable law and jurisdiction:

The General Conditions of Use are governed by French law. In the event of a dispute, the parties shall seek an amicable solution. Failing this, the Courts within the jurisdiction of the Paris Court of Appeal shall have sole jurisdiction to hear any dispute relating to the validity, interpretation or performance of the GCU, even in the event of multiple defendants or third-party claims, which the User acknowledges by accepting these terms and conditions.
